General terms and conditions
1. Scope of application
1.1 These General Terms and Conditions shall apply to the business relationship between Casamaura, Via dal Bagn 12, 7500 St. Moritz (CH) (hereinafter referred to as “Seller”) and the customer (hereinafter referred to as “Customer”) for orders placed in the online store. The most current version at the time of the order is valid.
1.2 For questions or complaints you can reach us during our normal opening hours.
2. Warranty
2.1 The customer must inspect the product immediately upon receipt of the delivery and report any defects in writing within 3 working days. After that, the product is considered approved and all warranty claims are forfeited. A reduction of the purchase price is excluded.
2.2 If the purchase is for the delivery of a specific acceptable product, the Seller shall have the right either to take back the defective product and refund the purchase price or – taking back the delivered, defective product – to deliver another, identical product.
2.3 Any further warranty is excluded.
3. Orders
3.1 The customer can place products in the shopping cart from the seller’s online store without obligation.
3.2 To complete the ordering process, the customer must enter all the necessary data on the “Checkout” page and click on the “Submit Order” button.
3.3 The customer will then receive an automatic confirmation of receipt by e-mail, in which all data relating to the order are summarized. This confirmation documents the receipt of the order, but does not yet represent an acceptance of the request, but the customer is bound to the order. The purchase contract is not concluded until the seller has handed over the ordered product to the shipping department and the customer receives an e-mail that the order has been completed and the product has been shipped.
3.4 If the customer has selected the payment method prepayment, the goods will be reserved for a maximum of 10 calendar days after sending the order confirmation. If the payment is not received by the Seller within this period, the Seller shall withdraw from the contract and the product shall no longer be reserved. In this case, the order is void.
4. Prices
4.1 All prices on the online store are inclusive of VAT.
5. Terms of payment
5.1 The customer can choose from the available payment methods before completing the order process.
5.2 In the case of payment via third party providers (PayPal), their general terms and conditions apply
5.3 Payment must be made in advance.
6. Delivery
6.1 The products are made by hand. Therefore, a prolonged delivery period is to be expected.
6.2 In the case of payment in advance, delivery shall be made after receipt of the invoice amount.
6.3 Delivery costs inside Europe are already included in the Price. If you want to order from somewhere else, please contact us for the delivery costs.
6.4 Deliveries are sent either via Swiss Post AG, another delivery service or via the Seller’s own delivery service, at the Seller’s discretion.
6.5 Deliveries are made according to the delivery times of the used delivery service.
7. Liability
7.1 With the conclusion of the purchase contract, the benefits and risks are transferred to the customer.
7.2 The seller is liable for the product if the cause of damage is due to intent or gross negligence on his part. Liability for negligence is excluded.
7.3 If the product is damaged during shipment, the seller is liable. In order for compensation to be claimed, the customer must contact the seller within 3 working days of receipt of the goods. If this does not happen, the seller disclaims liability.
7.4 In case of a defective product covered by the liability, the customer has the possibility to receive an equivalent product as a replacement or to be refunded the purchase price.
8. Returns
8.1 Customers are requested to notify returns in advance by email to casamaura@maurawasescha.com.
8.2 The shipping costs for a return are to be borne by the customer.
8.3 The goods should be returned to the Seller in the original packaging with all accessories, if possible.
8.4 If it is not possible to return the goods in the original packaging, the Customer shall provide adequate protection against transport damage.
8.5 If the returned goods are defective or damaged, the Seller may refuse to refund the sales price.
9. Applicable law and place of jurisdiction
9.1 The place of jurisdiction and performance is 7500 St. Moritz, Switzerland.
9.2 Swiss law shall apply.
9.3 Contract language is English.
